BREAKING: An Australian man stuck in India has launched a legal challenge to the government’s controversial travel ban.

He is currently in Bangalore, India, and wishes to return to Australia but is prevented by the ban, his lawyer Christopher Ward SC told the court at an urgent hearing before Justice Stephen Burley on Wednesday afternoon.

Mr Ward said the ban is being challenged on four bases, two of them relating to how the courts interpret legislation, one about questions of proportionality, and the fourth a constitutional argument. The law banning anyone who has been in India in the past 14 days from entering Australia came into force on Monday and will be reviewed on May 15.

Is that another Charles and Camilla illegitimate son?

What on earth is someone doing in India with COVID happening? They had the opportunity to return home but didn’t, cricketers went to India for the money . Well suck it up folks ......

Good luck with that, champ. It didn’t work for boat people.

He resides in India. Can always go to the Maldives like others escaping the pandemic. 👍

Good on him! Hope he rips right into these clowns who show no respect to our nationals!

Good

he can try.

Knew the risk - no sympathy

Timely solution - allow flights from India, given one local Cooties case in the wild today in Sydney Gladys decrees flying people in is overly risky & all flights from India must land in WA, QLD & VIC. People demanding returns suddenly fall silent

I hope he looses the appeal

Good

India travel ban lands in court as stranded Australian launches legal actionAustralia's India travel ban is headed to court after an Australian citizen launched legal action in the federal court challenging its validity on constitutional grounds. It should. This is an absurd ban. Government can abandon its responsibility of erecting a well managed quarantine facility but citizens can't even return home when they want. democracy I hope all the Indian-Australians remember that this was also ScottMorrisonMP doing, when it comes to voting soon. Scotty does not have Australians backs and he believes we should feel privileged to be an Australian under his command.

Federal Court dismisses part of a challenge to the Australian Government's India travel banThe Federal Court throws out part of a challenge to a temporary ban on passengers travelling from India where COVID-19 infection rates have been escalating. Sounds like a pretty simple reasoning, and one the act/regs would have likely detailed, meaning the challenge is likely to lack substance and be a bit thin. What did they think would happen, Citizens in Malaysia have more constitutional rights than us. The one positive of Covid has been people realising how few rights we have & the inability of Courts to uphold 'implied rights' Article doesn't say which part was thrown out & what remains
