The urgent application filed in federal court in Sydney is being held this afternoon. 9News

Gary Newman travelled to India to visit friends in March last year and has been unable to return.A passenger jet makes its final approach for landing into Sydney Airport.

Mr Newman is being represented by Michael Bradley and Chris Ward SC, who are working pro bono to overturn the travel suspension. "The constitutionality of a proposed law criminalising return of Australian citizens from particular specified countries is deeply questionable," Dr Ward tweeted earlier this week.

The lawyers will argue the emergency declaration is invalid because of an implied freedom to be able to return home.Health Minister Greg Hunt declined to comment on the case when holding a press conference in Melbourne earlier this afternoon."More than one in eight passengers on the most recent flights were testing positive," he said.

Sad to say ,too bad mate, you'll just have to wait your turn !

Australians in Australia first priority. Travellers had the opportunity to return. Morrison is right to protect Australians.

He went there at start of pandemic last year!!! Against advice to travel!!! Everyone was told this back in March, those that were os or had already left were told either stay where you are or come home NOW!! That's the risk he took. Too bad so sad.

The ban is justified

This dictorial govt has the hypocritical hide to berate China.... on absolutely NO evidence

How about mentioning outbound travel when it’s one way please? Holding citizens in is just as bad.

Please keep the selfish out of Australia.

Who would we blame if there was a massive breakout of Covid and had to suffer lockdowns again?

Lawyers and news broadcasters are the only winners in this case. MONEY MONEY MONEY.......

Welcome to the American way Australia.

Lol, the idiot went there at the height of the initial pandemic coming into play, there were massive statements not to travel unless you had to or would get stuck there, what a fool. He went to SEE FRIENDS. Unlucky/Stupid or both.

It wont stand up Yes, there should be better quarantine facilities. No, people should not have been granted exemptions to attend weddings and funerals. Yes, it’s generally wrong to block citizens from returning home. But the immediate threat is the surge in Covid cases and variants.

India travel ban lands in court as stranded Australian launches legal actionAustralia's India travel ban is headed to court after an Australian citizen launched legal action in the federal court challenging its validity on constitutional grounds. It should. This is an absurd ban. Government can abandon its responsibility of erecting a well managed quarantine facility but citizens can't even return home when they want. democracy I hope all the Indian-Australians remember that this was also ScottMorrisonMP doing, when it comes to voting soon. Scotty does not have Australians backs and he believes we should feel privileged to be an Australian under his command.
