Lawyers for an Australian man stranded in Bangalore, Gary Newman, filed an urgent application in the Federal Court on Wednesday, seeking to challenge the Morrison government’s coronavirus travel ban from India travelban Auspol coronavirus

A 73-year-old Australian man stranded in Bangalore, India, has filed a legal challenge to the Morrison government’s coronavirus travel ban that has made it a crime for him to return home.

Prime Minister Scott Morrison has insisted the measure is a “proportionate” response to a surge in COVID-19 cases in India, while Mr Hunt said on Monday it was his “strong, clear and absolute belief” that it was legally valid. But legal experts have questioned whether the ban falls foul of the Commonwealth Constitution.

Dr Ward asked the court to deal with the first two grounds first, relating to statutory interpretation, because they required less evidence and preparation.

Federal Court dismisses part of a challenge to the Australian Government's India travel banThe Federal Court throws out part of a challenge to a temporary ban on passengers travelling from India where COVID-19 infection rates have been escalating. Sounds like a pretty simple reasoning, and one the act/regs would have likely detailed, meaning the challenge is likely to lack substance and be a bit thin. What did they think would happen, Citizens in Malaysia have more constitutional rights than us. The one positive of Covid has been people realising how few rights we have & the inability of Courts to uphold 'implied rights' Article doesn't say which part was thrown out & what remains

India travel ban lands in court as stranded Australian launches legal actionAustralia's India travel ban is headed to court after an Australian citizen launched legal action in the federal court challenging its validity on constitutional grounds. It should. This is an absurd ban. Government can abandon its responsibility of erecting a well managed quarantine facility but citizens can't even return home when they want. democracy I hope all the Indian-Australians remember that this was also ScottMorrisonMP doing, when it comes to voting soon. Scotty does not have Australians backs and he believes we should feel privileged to be an Australian under his command.

Lawyers prepare to challenge legality of 'un-Australian' India travel banAssistant Multicultural Affairs Minister Jason Wood says most Australians support the federal government's controversial India travel ban, as lawyers prepare to challenge its legality in court. 'voters have been largely supportive of hard-line border policies'. Here's an exercise, name one human rights abuse against a minority group that doesn't have widespread public support. By the time this gets to court and a ruling is made. The government would have lifted the ban. I would like to see the whole travel ban challenged. It wont stand up Yes, there should be better quarantine facilities. No, people should not have been granted exemptions to attend weddings and funerals. Yes, it’s generally wrong to block citizens from returning home. But the immediate threat is the surge in Covid cases and variants.
